David is a senior commercial litigator for the firm. He has a proven track record of success representing clients in proceedings in the High Court, District Court and in appeals to the Court of Appeal.

David also acts for clients in specialist jurisdictions and Tribunals, such as in Construction Contract Act adjudications, the Real Estate Agents Disciplinary Tribunal, the Māori Land Court and Māori Appellate Court, the Weathertight Homes Tribunal, and the Coroner’s Court.

David’s expertise lies in contractual and property disputes,construction disputes, debt recovery, relationship property, and estate litigation.

His clients include corporate entities (from small to national-sized businesses), private individuals, and Local Authorities.

Relevant Experience & Recent Major Projects

  • Representing landowners in an appeal to the Court of Appeal over the maintenance of covenants registered on a title for a property the landowners had subdivided and sold.

  • Representing shareholders in an arbitration involving claims of misrepresentation, tax-loss adjustments, and share-valuation methodology, for a farming company.

  • Representing a property owner in the High Court to obtain sale orders against the property’s co-owner who refused to sell and refused to agree to a buy-out proposal.

  • Representing property owners in the High Court to obtain orders declaring an occupier of their property to be in unlawful possession.

  • Representing a national fuel provider in injunction proceedings in the High Court to uphold a decision not to renew a retailer’s lease.

  • Representing a building company to get claims dismissed in adjudication proceedings brought under the Construction Contracts Act 2002.
